the remaining part of my monies and all other movables to be equally made into three parts; two parts of same to my two sons and one part to my two daughters. I likewise order my daughter widow Jane Wharly the sum of 2/8. I likewise order my dwelling house and kill to my son John and my other office houses and my garden to my son James; and as for that part I order to my daughter Margrat  I order it to the care of Samuel Beatty and Archbauld Beatty they to put it to best advantage for the rest of the small children, and there must nothing be done with my house during my wife's life and yearly during her life 3 sums grazing and 3 barrels of shilling to be paid to her. I likewise order my burial to be paid out of my own monies. I order 20/- to be paid to John Wharey/Wharly. I order William Clouff and William Falls to see to an "equallisment of all things made." I order one suit of clothes to my brother.

On 10 June 1740 John Beaty and James Beaty the sons and heirs - at law to Testator swears to execute the will. Before John Davies Indorsed: "James Beatty, Dromdarge, Inniskillen."

(108) Clogher Will:
James Beaty of Aghnaclogh, county Tyrone, farmer.
All my goods and chattels in Tattyreagh? to the children by me begotten on the body of my well beloved present wife Diana Maxwell which said goods and chattels are to be sold and the money arising from sale thereof to be put to interest for the care of said children named Margaret Beaty, Jane Beaty, James Beaty, Samuel Beaty, Thomas Beaty, and Robert Beaty, all being my children of said Diana till they are 21 or be married, and then equally among them; and I bequeath the rents of Callolongford and Tattyreagh? yearly to my said children during their minority.

To my eldest son John Beaty by my former wife 20 pounds if he behave and marry with consent of my executors, if not only 15 pounds.

To my son William the other son by my former wife the sum of 15/0 in full of all claims.

To my said son James Beaty my oldest son by Diana Beaty the lands of Tattyreagh aforesaid during my lease of it when he is 22 and he to marry with consent, but if he d.s.p. same to my second son Samuel by Diana upon the same condition. Failing him to my son Thomas Beaty by Diana; and should my sons James, Samuel and Thomas all d.s.p then all to my well-beloved daughters
