the father of Plt. was seized of sd. lds of Wateraghy and also of the lands of Cloon, Co. Leitrim, to which latter lands Claud was intitled to in right of his first wife and being so seized he made his will dated 25 Jan. 1770 and bequeathed to Plt. & Claud Beatty another of his sons, who were children of his 2nd marriage the sd land of Wateraghy. Believe that testator died leaving 6 sons, Viz: Archibald, George, William, John, Claud and Plt. and four daughters. Admit that Archibald, George, Wm. and John were the issue of the first marriage. Say that testator appointed Plt. one of the exors, and admit that George Beatty was also another exor. and kept possession of Claud's will till he died. Admit that Plt. together with George Beatty and one Francis Beatty the son-in-law of testator were appointed exors of sd will. Do not believe that George Beatty would not show the will as alleged or that on account of the allegations made by Plt. never proved the will or that George Beatty was dishonest or at all concealed the will; on the contrary George Beatty showed a true copy of the will to Plt. Admit that after the death of George Beatty his papers came to the hands of Deft George Crawford as one of his exors and who is married to a grand-daughter of George Beatty. That George Crawford in July 1808 handed the original will of Claud Beatty the elder to Plt in the same state as Deft George Crawford recd. same to a son of Plt's for the purpose of using said will on the trial of an ejectment. Say, the copy of the will given to Plt was made by one Thompson. Believe that Claud Beatty the elder declared while executing his will his intentions to leave Cloon, which came to him by his first wife to her children. That George Beatty died 1805 having made his will of which will Francis West, McVitty Moore, and Deft George Crawford are exors. and he left Cloon to his grandsons, John West and Francis West, and Francis West having since died John West is the heir and is now a minor. That Claud Beatty the younger died about 1779 leaving issue two daughters his heiressess. That George Beatty was a man of the highest moral credence, and also that he and Wm. Beatty were joint lessees with their father in the lease of Wateraghy and although they allowed the Plt. and his brother Claud Beatty to enjoy the profits there of yet sd profits were much greater than Cloon.
