£5 a year would not be inadequate out of Cloon in as much as said lands did not produce more than £100 yrly and £5 was the highest rate of an agent's fee. Admit that George Beatty after the death of his father Claud and of his brothers, Archibald, William and John intestate and without issue became intitled to Cloon; but he was independent as heir-at-law to John's share of which he was custodian on account of a debt due to him by John. Admit that about 1773 the lease of Cloon being vested in George Beatty (who was one of the lives in the lease there of ) surrendered same and got a new lease of the inheritance there of for three lives: one of which lives is in being and is about 44 years old and George during his life time received the profits there of . That George Beatty died in 1805 having made his will and appointed Francis West, McVitty Moore, and Deft. George Crawford to be exors and devised Cloon to his grandsons John & Francis West. That Francis West the younger has since died and John is his heir and now a minor, and Cloon is not subject to any claim of Plt. but is subject to a charge of Deft Francis West and Elizabeth his wife who is a daughter of George Beatty. That Claud Beatty the younger died about 1779 leaving two daughters his co-heiressess. That Elizabeth West and Frances Moore the wives of Francis West and McVitty Moore are heirs to George Beatty. That George Beatty was a man of the highest moral character and incapable of committing the frauds imputed to him by Plt. That George and Wm. Beatty were joint lessees with their father Claud in the lease of Wateraghy and were intitled at their father's death thereto in light of survivorship and which right to sd lands they did not assert but permitted Plt. and his brother Claud to enjoy same and the profits there of were more valuable than Cloon. That Claud Beatty the elder was seized of the lands of Cloon for his own life and for the lives of his sons Archibald and George, and Archibald died in 1772. That when Claud Beatty the elder died his son George was 40 years of age and Plt. about 18 years old and Claud Beatty the younger about 21. That George Beatty got a renewal of the lease of Cloon in 1773 for the lives of John Beatty and Claud Moore and Edward Beatty the latter of whom is now only living, and the profits of Cloon from 1770 to 1780 were about £70 and from 1780 to the time George Beatty died in 1805 about £110.
