So it is said Rowland Bettie and James Johnston combined to defraud PLTs refuse to come to an account or to pay said legacies to PLTs saying they have not any assets, although in truth they have received debts due to said John Crosier, in particular one debt which was owing by Dr. John Lesley, deceased, which debt has been paid to them by James Lesley, Esq., son and heir to said Dr. John Lesley.  Pray that writs may be granted against Rowland Bettie and James Johnston to answer in the premises.   Bill entered 24 April 1708.

           Plaintiff James Johnston, gent., sheweth.  That one John Betty being seized in fee of the lands of Toolcurlick, Ardverny and Ferrardle, the 4 tates of Edenmore and the 3 tates of Cullin’s and the 2 tates of Killicullow, did by deed in 1695 convey said lands to PLT to hold to PLT. and his heirs forever and gave PLT. livery and seizen of same and PLT. was possessed of said lands for several years until about 5 years since when by order of the Trustees appointed by Act of Parliament for the sale of forfeited estates in their Kingdom PLT. was dis-seized and dispossessed of the 9 tates of Edenmore, Cullens and Killcullow by the said Trustees who pretending that said lands were the lands of one Conconaght Maguire who died in actual rebellion the same were vested in them by said Act, though the said Conconaght was not seized of said lands 4 years before the rebellion of 1688 nor ever after, but that John Betty was seized of said lands for a long time before 1688 and the Deft. Bryan Maguire soon after said lands were seized by order of the said trustees pretending said lands were the lands of Conconaght Maguire and were settled on him (he Deft. Bryan) entered his claim before said Trustees who found that Conconaght Maguire had no title to said lands or was possessed of said 9 tates in 1688, they ordered possession of said lands to be given to Bryan Maguire who is now in possession of same and threaten to keep PLT out of same, although Bryan Maguire had no title thereto, but the title is soley vested in PLT.    That as to the lands of Toolcurlick, Ardverny and Ferrardle, Plt. continued seized of same till about 2 years since when Deft. Rowland Betty disseised Plt. of the lands of Ardverny and Ferrardle by evicting PLT.’s tenants and pretends that said John Betty had granted a conveyance of Ardverny and Ferrardle to one Crosier under whom Rowland Betty pretends to claim a long time before the conveyance made by John Betty to PLT:  That Plaintiff
