said lands to PLT. wherein PLT. entered and was possessed of same for some time and enjoyed same and hoped to enjoy same according to PLT.’s purchase thereof.  But now so it is John Betty combining with John Crosier of county Fermanagh, and Ryan McGuire of county Fermanagh, gents. in order to obstruct PLT. in his purchase money and also of his purchase of said lands, they the said John Crosier and Ryan McGuire by combination with John Betty forcibly entered on PLT.’s possessions of the lands and do thereon set at a title under some deed of mortgage or estate for life or term of years made by John Betty to John Crosier and Ryan McGuire.  That John Betty had not power to charge said lands with any mortgage estate for life or years having already conveyed same to PLT. and if such conveyance was made it was frauchulent and was upon some trust or agreement long since performed by rededemption or had been revoked and possession of the lands did not go to John Crosier or Ryan McGuire.  That John Crosier and Ryan McGuire have got several deeds and writings from John Betty comprehending the title to said lands and do detain said deeds from PLT.  That PLT. had to bring his ejectoment in the Pleas office of this Court to recover said lands and John Crosier has taken it upon himself to defend same and Ryan McGuire says he does not design to take upon himself to detain said lands.  But PLT. cannot bring said ejictment to a trial at common law without the title deeds whereby John Betty held the lands, which deeds are in the hands of John Crosier and Ryan McGuire .  Prays that writs may be granted against John Betty, John Crosier and Ryan McGuire to produce said deeds and answer in the premises.   Bill collected 3 May 1706

      Plaintiffs:  Andrew Crosier, Robert Crosier, John Crosier and Katherine Crosier, minors under 21 by James Ballentine their guardian, and Anne Crosier, shew.  That John Crosier late of Cavan, county Fermanagh, gent., grandfather to PLT.s on 29 June 1706 made his will whereby he derived several legacies to PLTs, viz: to PLTs Andrew £50; to PLT. Robert £40; to PLT. John and his heirs for ever said lands of Cavan on which testater then lived and the sum of £20; to PLT. Anne £80; and to PLT Catherine £40; and apportion Rowland Bettie and his cousin James Johnston exors.   That said John Crosier died in the following July or August wherefrom James Johnston and Rowland Bettie proved said will and have possessed them selves of the real and personal estate of said John Crosier to a considerable value more than would pay his debts and legacies.
