Notwithstanding, William Williams the son and heir of said testator by agreement with said exors has entered upon said lands, having agreed with the exors to pay testator’s debts, and has for several years received the profits thereof. That Plt. in the time of the late troubles went into England for safety to avoid the said troubles. Plt. having put himself into H. M.’s service and continued in the army in Flanders till the year 1697 and then returned to Ireland. That said Peter Wertensor and Henry Guilter, two of the exors, being dead, Plt. applied to Charles Meredith, Joseph Woodward, and John Hatch the surviving exors to pay the debts of testator, and they told Plt. they had handed over the estate to William Williams the son and heir who had agreed to pay said debts and accordingly to whom Plt. applied. That Wm. Williams acknowledged said debt was due and that it ought to be paid, but said there was great incumbrances on the estate and he had already paid off some but there still remained several incumbrances unpaid, but he would anure Plt. his debt. That Wm. Williams the testator owed but few debts besides that due to Plt. and if any incumbrances remained on the estate same were legacies bequeathed by the testator, and all profits which have accrued since testator died would have paid same. But Wm. Williams alleges there are other incumbrances to be paid. That Wm. Williams in an account with his brother Thomas Williams, with whom he had a difference concerning said lands in some bill preferred against Wm. Williams, he (Wm.) in answer to said bill said that Plt’s debt was an incumbrance on the estate and yet refuses to pay Plt. That said Wm. Williams, Charles Meredith, Joseph Woodward, and John Hatch combine together and refuse to pay Plt. the £40 which is owing him since the year 1687. Prays that writs may be gtd agst Wm. Williams, Charles Meredith, Joseph Woodward, and John Hatch, to answer in the premises.     Bill entered 29 April 1700.
