or July 1757 put Samuel in possession of said moiety of said premises, and said Robert Beatty died soon after leaving Mary Beatty his widow and said Samuel Beatty and Jacob Beatty his sons, but before he died he made his will, and bequeathed to Jacob Beatty, who was elder brother to Samuel, his dwelling house and that part of the farm of Lisnashere running from the ditch to the turf bog in Danaghcloney and adjoining the farms of Wm Litta and Josh Beatty, he to pay half the rent and also bequeathed to his sd son Samuel the part of said farm running from the highway to the end of the barn and so to the turf bog aforesaid, and did bequeath all his goods to his widow Mary and to his sons Jacob and Samuel, equally, and bequeathed half the meadow lying next to Jacobs portion and half the turf bog to Jacob and the other half to Samuel, and appointed Samuel Campbell and Samuel Perry exors, who proved said will. That Samuel Beatty from the time his father died was possessed of said premises so devised to him, and so was Jacob of his devise. That Samuel Beatty married Plt. Jane by whom he had several children of whom Plt. Mary is the only survivor. That Samuel did intestate in Sept. 1758 leaving Plt. his widow and Mary his only child and admin of Sam was gtd to Plt. out of the diocese of Dromore. That Jacob Beatty soon after the death of Samuel Beatty claimed Samuels portion of said farm and in 1759 forcebly entereed upon same and turned out Plt. and her child Mary, and all their goods out of the dwelling house and took Plt’s farm stock and refused to re-instate Plt for several months, and put Plt. to much expense of issuing a replevin in H. M’s court of Chancery to recover her rights; and hath also for three years possessed himself of said meadow belonging to Samuel. That Jacob Beatty taking such possession in 1759 caused damage to the Plt. to the extent of £6. That in February last Jacob Beatty again forcibly entered upon Plt’s farm and ploughed same and sowed grain thereon and says he will reap same for himself and that he will again turn Plt out of the farm. Now so it is Jacob Beatty combining with said Samuel Campbell and Samuel Perry doth refuse to leave Plt in quiet possession of the farm. Prays that writs may be issued agst Jacob Beatty, Samuel Campbell and Samuel Perry. Interest 8 Dec. 1761.
   The amended bill is almost a duplicate except it states that Samuel Campbell and Samuel Perry the exors of Robert Beatty’s will have renounced their exorship and that admon has been granted to Mary Beatty the widow and James Beatty a son of testator. That now Jacob Beatty combines with said Mary Beatty and James Beatty. Prays for writs against Jacob Beatty and the other confederates. Amended bill entered 2 June 1762.
