February 28, 1737. “Memorial of an Indenture Quadripartite…made between Wm. Martin of Lincolns Inn in the county of Middlesex Esq’r of the first part Benjamin Burton of Burton Hall in ye county of Calherlogh in the Kingdom of Ireland Esq., Exr of the last Will and testament of Samuel Burton late of the city of Dublin, Esq. deceased who was Exr of the last Will and Testament of Benjamin Burton Esq. late Alderman of the City of Dublin his late father dec’d, William Batty of Clerktonwell Green in the County of Middlesex Gent., Richard Welman of the city of London Gent, Samuel Cotton of the same city Esq., Richard Wolfe of Lincolns Inn aforesaid Gent., Charles Clarke of Lincolns Inn aforesaid Esq., and Neal Ashley of Lincoln Inn aforesaid Gent of the second part; Frances Bowyear of the Six Clerks Office London Gent of the third part and Solomon Ashley of the parish of Saint Margarets Westminster Esq. and Winifred his wife Exr of the last Will and Testament of Alexander Pitfield late of Boxton in the said county of Middlesex Esq. her late father deceased who was the sole Exr and Devisee of Dorothy Pitfield deceased late wife of the said Alexander Pitfield of the 4th part. Whereby the said Wm Martin, Benjamin Burton, Wm. Batty, Richard Welman, Samuel Cotton, Richard Wolfe, Charles Clarke and Neale Ashby by the direction of the William Martin for the consideration therein mentioned and in pursuance and for performance of an agreement and an order of the high Court of Chancery therein also mentioned Grant bargain sell assign transfer and set over unto the said Francis Bowyear his Exr & Adm & assigns all those several Towns, Villages and lands in the said County of Calherlogh [Carlow] in the province of Lunster and Kingdom of Ireland containing by estimation twenty one thousand one hundred and seventy four acres more or less limited or settled by on or to Walter Butler and Patrick Colelough therein named for a term of five hundred years therein mentioned. And also all that Barony of Idrone (?) and ye Man and capitol messuage of Dunlecney [Dunleckny] and the messuages lands and hereditaments thereunto respectively belonging heretofore to the Estate of Dudley Bagnel dec’d late father of Walter Bagenal in the said county of Calherlogh [Carlow] & all other messuage lands & tenements and hereditaments cont’d or expressed in the Rentals particular to the said indenture annexed and hereinafter mentioned, that is to say, the Rental or particular before referred to the Estate in the County of Calherlogh which begins at Stapletown being just thirty miles from Dublin and is generally called the Barony of Idrone. Martin, Benjamin Burton, Wm Batty, Richard Welman, Samuel Cotton, Richard Wolfe, Charles Clarke and Neal Ashby and of each and every of them by from or under or in trust for the sd Wm Martin or at by or with his nomination, means consent or procurement of into or out of the said Barony, Manor, messuages, lands, tenements, hereditamnets and premises and every of them and every part and parcel thereof severally and respectively therein yet to come and unexpired ?? nevertheless for the several uses, trusts, intents and purposes in the said last mentioned agreement and order of the sd High Court of Chancery and in the said deed mentioned, that is to say, In trust for carrying on and enabling the said Fran’s Bowyear to carry on or commence with effect proper suites and measures to compel the speedy payment of the said debt to the said Solomon Ashley and Winifred his wife and to subject in trust for the said Wm. Martin according to the form and effect of the said agreement and orders of the High Court of Chancery and particularly in trust that out of next money to be recovered by virtue of the said agreement there be allowed and paid as got in ten pounds by the hundred to the said Wm. Martin to be reimbursed to the said Solomon Ashley and Winifred his wife out of the money which shall come to ye hands of the sd Wm. Martin after payment of the debt due to the said Solomon Ashley and Winifred his wife in manner therein mentioned and from and after the full payment to discharge thereof with all interest and cash according to the true intent and meaning of the same agreement and order for trust for the sd Wm Martin his Exrs Adms & assigns and to and for no other use trust intent or purpose whatsoever and the sd Wm Martin doth hereby constitute and appoint the said Francis Bowyears his true and lawful attorney irrevocably for the purposes aforesaid with other usual clause and covenants therein mentioned which said indenture as to the perfection thereof by the said Wm. Martin, Frances Bowyear, Solomon Ashley and Winifred his wife was witnessed by Thomas Martin of Clapham in the county of Lurry Esq. & John Martin of ____ in the county of Glocester, Esq. & James Martin of London, Goldsmith, Samuel Billingsley of Chancery Lane in the County of Middlesex, stationer, William Powell, Clke to Israel Woollaston of the Middle temple, London, Gent and Edward Claney of the City of Dublin Gent…”
