the profits of said lands and Plt. was next and only Protestant heir-in-law to Andrew Magauran deceased, and the first real Protestant Discoverer and thereby intitled to said lands of Tonemore.  That said Mary Magauran, Ferrell Magauran, and Wm O'Bryan answered said Bill.  That said Robert Beaty died on the 1st January last without answering, and died intestate leaving John Beaty his eldest son and heir-at-law and Anne Beaty, his widow who have administered to him.  That Robert Beaty at the time he died possessed said lands under same deed executed to him by Plt. by the persuasion of Bryan Magauran deceased in trust for Bryan Magauran and his heirs.  By the death of Robert Beaty said bill and proceedings have abated.  To the end therefore that said John Beaty son and heir of Robert Beaty and Anne Beaty his widow and admix may answer in the premises prays that writs may be grd agst them.  Entered 1 April 1758

Plaintiff Arthur Leonard of the city of Dublin, barber, a Protestant of the Church of Ireland, sheweth.  That Robert Beatty late of Springtown, co Longford, gent., being seized of fee of inheritance of the town and lands of Tonywarden, co. Longford, he on 28 April 1743 by articles devised to Bryan McMally of Monypull, co. Longford, said lands of Tonywarden (except that part set to Mathew Brady and another part called Rha martin) for the term of 31 years from 1 May then next at 7/-- or 8/ rent per acre, Robert Beatty to make a ditch on the boundaries thereof and to build a house on the premises, and also to execute a lease thereof to Bryan McMally.  That Bryan McMally accordingly entered on the premises and enjoyed same for several years and said farm contained 199 acres and continued in his possession for 7 years.  That Bryan McMally was a Papist and therefore disqualified to hold said farm.In order to elude the Act of Parliament Robert Beatty did not execute a lease but pretended to set the farm by another agreement to Bryan McMally.  That in 1754 or 1755 Robert Beatty died intestate leaving John Beatty his oldest son and heir a minor and Anne Beatty his widow to whom admors has been grd. and she was appointed by some ecclesiastical court to be guardian to said minor, and has received the profit rents of said farm since her husband died.  That Plt has applied to Bryan McMally, Anne Beatty and John Beatty for possession for said farm in a much he is the first real Protestant Discoverer, and they refuse to come to any agreement with Plt.
