Plaintiff John Betty sheweth that he is the son of Thomas Betty late of Ballindollogh, co. Fermanagh, deceased, who married one Jane [recte Margaret] Little one of the sisters of William Little, late of Tully, co. Fermanagh, deceased. That said Wm. Little was seized of considerable estate real and personal consisting of plate, jewels, rings, cash, bills, bonds, leases for lives and years and of a considerable estate in fee in all amounting to £5,000 and upwards and being so seized fell ill in July 1712 when he made his will as is pretended by one Mrs. Katherine Callwell who came about that time to see him and who did send for the Rev. John Smith

Minister on 20 July 1712, and then as is pretended he (Little) desired Mr. Smith to write his will in the presence of his friends as follows: -- To Madame Catherine Callwell £100, the silver tankard and 2 silver tankards; to Master Sidney Humes £20 and the black mare; to Charles Humes £15; to James Humes £15; to Gustavus Humes £15; to James Patterson 80 cows, 2 garrans?, and 2 mares; and John Patterson shall have the 3rd part of said farm stock; and James Patterson and John Patterson shall have the farm of Tully during the lease thereof at £16 rent; to James Patterson and John Patterson the two parts of my household goods; to the poor of the parish £3; to Ellen Patterson daughter of James Patterson & to Catherine Cole £20; to said Ellen Patterson £10; to Thomas Sumervell the lease of Monaghew at £9-10/- rent; appoint Thomas Somervell and John Stevinson exrs; the residue of my effects among my nearest and poorest relations at the appointment of Thomas Sumervell and John Stevinson, and the poorest to have the best share. That Mr. Smith leaving William Little’s room (as is told by sd Katherine Callwell) with Thomas Somervill and John Stevinson to put said words in writing, while they were absent Wm. Little grew speechless (and continued so till he died) before same could be signed, and he died a day or two afterwards, whereby said will was not executed. That notwithstanding it is alleged as well by Thomas Sumerville and John Stephenson (supposed exrs) as by said Katherine Callwell (principal legatee) and others their confederates that William Little died in that condition without making any former will. That by the means of said Katherine Callwell who directed Mr. Smith to write the will as aforesaid in favour of herself, and by contrivance of said Thomas Sumervill and John Stevinson they soon after the death of Wm. Little procured letters testamentary or letters of administration of Wm. Little’s goods in the diocese of Clogher, and Sumervill and Stevinson seized all Little’s estate amounting to £5,000, and they have by the advice of Henry Callwell and said Katherine his wife disposed of same as they thought expedient to their own advantage without allowing Plt. any competency thereout as they ought, in regard that William Little died intestate and also that Plt. is nephew and near relation to Wm. Little, and thereby is intitled to a seventh share of his effects as being the son of Jane [recte Margaret] Betty alias Little one of the sisters of said Wm. Little. That William Little had no relations either in this kingdom or in Great Britain when he died saving only four sisters, viz: whereof one Margaret Little married Plt’s father Thomas Betty by whom he had issue three children viz: Plt., John Betty, Ellinor and Jane Betty. That Plt’s sister Ellinor married Wm. Offodoghan and Plt’s sister Jane married Thomas Willson who is since dead and Jane is now a widow. That Plt’s father died a few years past leaving no other issue after whose death Plt’s said mother Margaret Betty married John Carron by whom she had issue Thomas, William and Jennett Carson, all minors. That another of Wm. Little’s sisters, viz:

Ellinor Little married Thomas Whiteacre by whom she had issue three children, viz: Margaret, Thomas and Anne Whiteacre, two of whom are still living, viz: Thomas and Margaret Whiteacre, and said Margaret has lately married with one [______] and said Thomas Whiteacre the elder having died, his widow Ellinor Whiteacre alias Little continues still to be his widow. That another of Wm. Little’s sisters, viz: Jane Little married John Owens and had issue two children, viz: John and Jennett Owens, which Jennett Owen is still unmarried. That Wm. Little had another sister called Elizabeth Little who sometime before his death married Robert Summerville (father to Deft Thomas Sumerville) and Robert Sumerville had issue by her five children, viz: said Thomas Sumerville, Margarett, Mary, Ellinor and Ann Sumervill. That said Robert Somerville died about 1708 and his wife said Elizabeth Sumervill alias Little died soon after him. That said Margarett Sumerville married with [______]; said Mary Somerville married with [_______]; said Ellinor Sumerville married with [_______]; and said Ann Sumerville has also married with [______]. That said Thomas Sumerville and John Stephenson have paid most part of aforesaid persons their shares of Wm Little’s effects, and they being in strict combination(?) with Thos Sumerville and John Stephenson will not confess to Plt what they so got for their shares and also T. Sumerville and J. Stephenson refuse to give any account of such goods that Wm. Little died seized of or give any part thereof to Plt. for his share although he is son and heir apparent of William Little’s eldest sister said Margaret Betty alias Little. That notwithstanding said Sumerville and Stephenson have paid to Catherine Callwell or her husband Henry Callwell the legacies devised to her and her children by said pretended will although they know Plt had a right to a seventh part of said assets which proportion would amount to at least £100. That said confederates together with Thos Sumervill, John Stevinson, Henry Callwell and Katherine his wife strive to debar Plt there from, saying that Wm. Little died in such circumstances that there were scarce effects to pay his debts; and they also say that unless Plt will take £10 as they have offered to him he will never get a grot and they will also lay Plt. in goal if he demands any more, they depending upon Plt’s poverty and mean capacity, well knowing that Plt is not able to cope with them at law, and by such strength of hand they purpose to detain from Plt. his just right. Prays that writs may be gtd agst Thomas Sumervill, John Stevinson, Henry Callwell and Katherine Callwell his wife, Rev.
