sued James Patten for tithe due by him and of the mill of Magheriknock in the Consis: Court of Dromore held at Ballynohwich, he being tenant or occupier of said mill, and said Court ruled ( before the Rev. John Rowan, Surr; ) that PLT. was to be paid. That therefore as Patten earnestly solicited PLT. to defer the offices of the Court and he would buy PLT. 3 pounds for said tithes which was much less than was really due. That PLT. refused to accept same. Now so it is James Patten and John Beatie combining with James Perry and Hugh Browne ( said Perry being Register of said Consis: Court of Dromore and Browne a man of business in the country) they by management of Perry procured said cause to be removed from Ballynohwich to another Court of said Sir of Dromore held at Magherilin where PLT. was a stranger and PLT. who was much interested against PLT. contrived to pack cause against PLT in that court and Perry managed to have PLT. arrested by a prior issue from the Manor Court of Lisburn at Perry’s suit and kept PLT in custody till PLT paid Perry 3 pounds on a pretended debt due to him for PLT in and for expenses in incurred in prosecuting said cause. That Perry and Patten made great interest against PLT at the Magherilin Court by means of false depositions and witnesses in so much that PLT’s cause was dismissed and the case referred for award to Arthur Maxwell, Esq. as referee. Wherefore PLT neglected to pursue the cause in the Diocese of Dromore and Arthur Maxwell has neglected to make said award. [ Here follows some further particulars about PLT bringing the cause to Drogheda- tedious reading] Prays for writs against said Defts bill collect 21 July 1701.
